Scott and Scott Park Subdivisions

The purpose of this web page is to facilitate a better understanding on the part of the residents of Scott and Scott Park Subdivisions of the status of their Special Assessment District (SAD) and to follow the progress of the efforts to renew the SAD

(Scott and Scott Park Subdivisions will be referred to as "Scott Park" throughout this web page.)

Purpose of the Special Assessment District (SAD):

The Scott Park SAD was originally created as a means to facilitate the maintenance of the private roads within the subdivisions and provide a fair method of distributing the resulting costs to the property owners. 

The legal basis for special assessment districts and the procedural requirements to establish such, can be found in Michigan Compiled Law  Act 139 of 1972   and  Act 188 of 1954  .

Scott Park 2005 SAD Status:

Scott Park's current SAD will expire in 2010 if not renewed. It is important that the SAD be renewed and appropriate maintenance be maintained. Failure to maintain minimal maintenance would create safety related issues, both summer and winter. Our road system, with it's very narrow rightaways is marginal at best and currently creates less than desirable situations for both fire and medical responders. Any serious deterioration in maintenance would certainly hamper such efforts and might even cause significant increases in property insurance rates.

Procedural Requirements:

The establishment of a SAD requires a combination of petitions, public hearings, township board resolutions and the development of an "assessment tax roll" as the final step. This process, established by law, gives every opportunity for affected property owners to have their concerns addressed prior to implementation. Upon successful completion of this process, the "tax roll" is then submitted to the County Treasurer for implementation into the county tax system.

Scott Park SAD Renewal Timing Chart:

The timing chart available here is based on the requirement to have the Assessment Tax Roll completed, approved and submitted to the County Treasurers Office by their deadline of the last week of October, 2010.  This chart will be updated as progress and/or changes are made.  

Because of the various milestones and waiting periods which must be met along the way, that completion date requires signed petitions, representing at least 51% of the property owners, be submitted to the Township Clerk immediately following the 4th of July, 2010.   Should those petitions be available much earlier, the timing could be adjusted to reflect a more relaxed schedule.
